มาตรการทางกฎหมายในการควบคุมการเพาะปลูกกัญชาในครัวเรือนในประเทศไทย

บทคัดย่อ
งานวิจัยนี้มุ่งศึกษาวิเคราะห์มาตรการทางกฎหมายในการควบคุมการเพาะปลูกกัญชาในครัวเรือนของประเทศไทย โดยมุ่งวิเคราะห์กรอบกฎหมายของประเทศไทยหลังการกำหนดให้กัญชาออกจากบัญชียาเสพติดและให้เป็นสมุนไพรควบคุมโดยได้เปิดโอกาสให้มีการเพาะปลูกกัญชาในครัวเรือนซึ่งระบบกฎหมายปัจจุบันยัง ไม่มีมาตรการทางกฎหมายที่เหมาะสมในการควบคุมการเพาะปลูกกัญชาในครัวเรือนซึ่งอาจส่งผลกระทบต่อสังคมหลายประการจึงจำเป็นต้องศึกษามาตรการทางกฎหมายเพื่อควบคุมและแก้ไขปัญหาดังกล่าว งานวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยมีวัตถุประสงค์ 2 ประการได้แก่ (1) เพื่อศึกษาและวิเคราะห์เปรียบเทียบหลักเกณฑ์การเพาะปลูกกัญชาในครัวเรือนตามกฎหมายไทยกับต่างประเทศ (2) เพื่อศึกษามาตรการทางกฎหมายที่เหมาะสมในการควบคุมการเพาะปลูกกัญชาในครัวเรือน และ (3) เพื่อเสนอแนะแนวทางการปรับปรุงนโยบายทางสังคมและเศรษฐกิจในประเทศไทย ผลการวิจัย พบว่า ประเทศไทยควรมีแนวทางและมาตรการทางกฎหมายในการสร้างความสมดุลระหว่างผลกระทบทางสังคม การแพทย์ และเศรษฐกิจ การศึกษานี้เสนอให้มีการปรับปรุงกฎหมายเพื่อให้ครัวเรือนสามารถปลูกกัญชาได้ โดยผ่านระบบการขออนุญาตพร้อมแจ้งข้อมูลเกี่ยวกับสถานที่ตั้งที่ทำการเพาะปลูกและจำนวนของต้นกัญชาที่่เพาะปลูกได้ โดยอาจกำหนดจำนวนที่แตกต่างกันระหว่างผู้ที่ใช้กัญชาเพื่อการดูแลรักษาสุขภาพกับผู้ป่วยที่ใช้กัญชาทางการแพทย์์ในปริมาณมากอาจจำเป็นต้องมีความเห็นของแพทย์ประกอบการขออนุญาต มาตรการทางกฎหมายที่เหมาะสมจะทำให้การใช้กัญชาเป็นไปเพื่อสุขภาพและประโยชน์ทางเศรษฐกิจ ในขณะเดียวกันยังคงรักษาความปลอดภัยและความเป็นระเบียบเรียบร้อยของสังคม
