ความเข้าใจเบื้องต้นเกี่ยวกับกฎหมายที่อนุญาตให้ยุติชีวิตผู้ป่วย

การอนุญาตให้ยุติชีวิตผู้ป่วยเป็นประเด็นที่ซับซ้อนเนื่องจากจะเกี่ยวข้องกับแนวคิดของเรื่องความตาย สิทธิมนุษชน ระบบกฎหมาย รวมทั้งความพร้อมของสังคมและระบบริการสุขภาพของประเทศนั้นที่อนุญาตให้ดำเนินการได้ สำหรับในประเทศไทยเรื่องการอนุญาตให้ยุติชีวิตผู้ป่วยเป็นสิ่งที่ผิดกฎหมายและผิดจริยธรรมทางการแพทย์ เท่าที่ผ่านมามีความสับสนเรื่องการอนุญาตยุติชีวิตผู้ป่วยกับเรื่องการดูแลแบบประคับประคอง เรื่องการทำหนังสือแสดงเจตนาไม่ประสงค์จะรับบริการสาธารณสุขและเรื่องการยับยั้งการรักษาหรือการถอดถอนการรักษาเพื่อพยุงชีพผู้ป่วย ดังนั้นจึงควรศึกษากฎหมายและแนวทางการปฏิบัติของต่างประเทศเกี่ยวกับเรื่องดังกล่าวเพื่อเป็นแนวทางในการใช้และการตีความกฎหมายการแพทย์ของไทย และเพื่อคาดการณ์ ตลอดจนเตรียมความพร้อมในทางนิตินโยบายของรัฐไทยในเรื่องการการอนุญาตให้ยุติชีวิตผู้ป่วยในประเทศไทยต่อไป

“วินิจฉัยโรค” คือบอกว่า “เป็นโรคอะไร” การวินิจฉัยโรคเกิดจากการซักประวัติ ตรวจร่างกาย การ X-ray ตรวจทางห้องปฏิบัติการ ฯลฯ แล้วนำข้อมูลมาประมวลเข้ากันเป็นการวินิจฉัยโรคและในบางโรคจะมีเกณฑ์มาตรฐานในการวินิจฉัยที่เรียกว่า Criteria of diagnosis ซึ่งประกอบด้วยอาการแสดงของโรคถ้าผู้ป่วยมีเกณฑ์ครบตามที่กำหนดก็จะได้รับการวินิจฉัยว่าเป็นโรคนั้น
“พยากรณ์โรค” คือการบอกว่าผู้ป่วยที่เป็นโรคนี้จะหายเมื่อใดหรือจะมีชีวิตอยู่ได้นานแค่ไหน การพยากรณ์โรคเกิดจากหลักสถิติ การวิจัยและสังเกตโรคหรือสภาวะหนึ่งจำนวนมากและนานพอ จนทำให้พอจะเข้าใจการดำเนินไปของโรคตลอดจนความเปลี่ยนแปลงไปของสภาพร่างกายผู้ป่วย การพยากรณ์โรคจึงมีความคลาดเคลื่อนและเบี่ยงเบนได้เสมอตามสภาพร่างกายตลอดจนการดำเนินของโรคในผู้ป่วยแต่ละราย โดยการพยากรณ์โรคเป็นขั้นตอนถัดจากการวินิจฉัยโรค
