The role of the Administrative Court on controlling the administrations : focus on control the private hospitals in Thailand

All private hospitals and clinics in Thailand are subject to the criteria and conditions prescribed by the Hospital Act 1998. Department of Health Service Support, Ministry of Public Health is the main public organization responsible to supervise of all private hospitals. Even though the Ministry of Public Health, Department of Health Service Support and the relevant authorities are government agencies, they must strictly respect and follow the relevant laws and regulations as the Administration, and may be controlled by the Administrative Court. For decades, the Ministry of Public Health, Department of Health Service Support and public authorities, were filed before the Administrative Court only about ten cases. However, in each case of dispute, it was in the interest of people and Thai society. Thus, it is interesting to study deeply the principle of laws, the type of cases and the details of each case. These will bring academic benefits and knowledge to administrative law and health law.
