The Trade Competition Act B.E. 2560 was published in the Royal Gazette on July 7th, 2017 and has now been in effect. Although some provisions of this Act are similar to those of the Trade Competition Act B.E. 2 5 4 2, many are significantly modified. The objective of this article is to analyse 1 ) how provisions of this Act should be interpreted and applied and 2) if there are any loopholes or limitations in this Act? The analysis focuses only on the scope of application and control of behaviours of business operators with a dominant position. In this regard, EU competition law and German competition law are also comparatively studied.
