Nulla Crimen Sine Lege: A Survey of the Application of the Principle in the Anglo-American Legal System

At first glance, nullum crimen sine lege seems to be a straightforward principle, except it is not. Its application is ambiguous. This is quite ironic considering it requires the criminal law to be clear and certain. This paper explores the application of the principle in both Thai and Anglo-American (through English and the US’ s) legal systems. Its intention is to understand how to apply the principle fairly according to the rule of law and the constitution.
