Adoption Reform in Thai Legislation: child adoption by civil partners

Granted same-sex couple, registered civil partnership, the right to child adoption together can be considered as a development of family law and Thai society. Whether some arguments focused on LGBTQ’s child adoption are objective or just a concern of some people. The aim of this article is to show how evolution of Thai family effected Thai law. Then to affirm that a current Thai legislation neither govern new issues and nor respond to the needs of same-sex partners. Moreover, it also challenges State to reply to a crucial question if its policy brought a negative discrimination to LGBTQ. Therefore, when we take a requirement of the adoption law into consideration, we can ensure that it is one of tasks Thai State should achieve. The article has also presented a comparative study on cases occurred in France at the time they had addressed same difficulties. Moreover, a development of Thai society at the time that the new law was drafted regarding to the best interest of the child should be taken into consideration.
