Guidelines for Drafting an Employment Regulations Framework for Organizations with International Branches

Drafting employment regulations framework for organizations with international branches is both different and more complicated than drafting other types of regulations framework where both parties have full freedom of contract. Due to the fact that labor and employment laws put limitations on both parties’ freedom, labor and employment laws have to be taken into account while employment contracts are being drafted. It is therefore necessary to understand the particulars of each of the various national labor law systems. This paper summarizes important details of local laws by using the Tourism Authority of Thailand (TAT) as a model. The main conclusion of this paper is that it is highly necessary for organizations with international branches to first formulate an employment regulations framework, which may then serve as a basis or template for elaborating specific employment regulations at the national levels. A clear and comprehensive thematic framework must be established, and sufficient studies of local labor standards must also be undertaken. Moreover, it is important that the employment regulations framework be formulated along sufficiently broad lines in order to allow sufficient flexibility for national level regulations to be formulated in accordance and conformity with their respective national labor laws.
