No-Fault Compensation for Medical Accidents in France and Thailand

Medical damage is an unpreferable situation that medical service providers seek to avoid. Even though some medical injuries are predictable, some others are not. It is remarkable that when the fault liability system provides compensation for most damage caused by health services, there are many accidents not related to a fault. As a result, some countries have developed a system to compensate for non-fault damages to bridge the gap in law. France introduced a compensation system for non-fault medical damage through their laws by promulgating the Act no. 2002-303, 4 March 2002, relating to patients' rights and the health system's quality. In comparison, the National Health Insurance Act 2002, in particular, article 41 and the Social Security Act 1990, article 63(7), intend to support the preliminary finance for patients injured due to the non-fault medical and health services in Thailand.
