Problems Concerning “the General Right to Liberty” in the Thai Constitution B.E. 2560

Many concepts linked to the universal legal state and the principle democracy are enshrined in Thai Constitutions, but it appears that some of those concepts have been applied while some have been neglected to be applied inconsistently with those principles. It is undeniable that this has caused a significant problem to Thai constitutional system. The present Thai Constitution or the Constitution of the Kingdom of Thailand (B.E. 2560) contains Section 25 Paragraph 1, which has been described by the Constitution Drafting Committee as a new constitutional innovation as to help escalate the protection of individual rights and freedoms under the influence of the concept of “the General Right to Liberty” from foreign constitutional systems. However, the wording of Article 25, Paragraph 1 is significantly different from "the General Right to Liberty" in foreign constitutional systmes.
Firstly, there is a problem with the wording of the value of rights and freedoms in Article 25 paragraph 1 how it relates to human dignity and other rights and freedoms. Secondly, there is a problem with the wording of the level of protection of rights and freedoms in Article 25 paragraph 1 on what status to be protected and to what extent this covers. And finally, there is a problem with regard to the limitation of rights and freedoms in both substantive and procedural aspect. These problems reflect jurisprudence and values of the Thai Constitution that are different from universal principles, and they have implicitly been confirmed through decisions of the Thai Constitutional Court.
This study focuses on the wording and position to compare the provisions on “the General Right to Liberty” in foreign constitutional systems and Thai constitutional system in order to clarify the problems and find the values inconsistent with the principle of legal state and democracy hidden among the provisions and jurisprudence on the General Right to Liberty under Thai constitutional law
