Enforcing the Personal Data Protection Act B.E. 2562 : A Study on the Protection of Children's Personal Information

Abstract

Currently, the Personal Data Protection Act B.E. constitutes an essential element in the country, including the public and private sectors, have a crucial role to play in enforcing the law with maximum efficiency to protect the personal data of all individuals, particularly children. Children are individuals with the position of subject of rights, but they may not have fully developed physically and mentally to rely on themselves, particularly in making legal decisions or performing everyday tasks that involve personal data processing, which may directly impact their property or other rights. This article examines the laws related to protecting children's personal data in Thailand and other countries such as the European Union, the United States, and Ireland, which have specific practices for safeguarding such data, including limiting the scope of consent to the parent who may not necessarily be the father or mother. This study analyzes the necessity of protecting children's personal data and proposes guidelines for obtaining consent for personal data processing activities and preparing guidelines related to safeguarding children's personal information under the said law. This article aims to propose legal and policy recommendations to enhance the efficiency of law enforcement.
