มาตรการส่งเสริมวิสาหกิจเพื่อสังคมตามพระราชบัญญัติส่งเสริมวิสาหกิจเพื่อสังคม พ.ศ. 2562

บทคัดย่อ
การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษา 1) ความหมายและความสำคัญของวิสาหกิจเพื่อสังคมซึ่งเป็นการประกอบธุรกิจที่มีวัตถุประสงค์หลักในการแก้ไขปัญหาและพัฒนาสังคมหรือสิ่งแวดล้อมพร้อมกับการพัฒนาเศรษฐกิจ 2) มาตรการทางกฎหมายและนโยบายของต่างประเทศในการกำหนดมาตรการส่งเสริมวิสาหกิจเพื่อสังคมเปรียบเทียบกับประเทศไทย 3) สภาพปัญหาทางกฎหมายในการส่งเสริมวิสาหกิจเพื่อสังคมภายใต้พระราชบัญญัติส่งเสริมวิสาหกิจเพื่อสังคม พ.ศ. 2562 นอกจากนี้ ได้เสนอแนวทางแก้ไขกฎหมายไทยที่เกี่ยวข้อง โดยการวิจัยนี้เป็นการวิจัยเชิงคุณภาพที่ได้จากเอกสาร ได้แก่ กฎหมาย บทความ วารสาร ข้อมูลจากสื่ออิเล็กทรอนิกส์ทั้งในประเทศและต่างประเทศ ผลการวิจัยพบว่า พระราชบัญญัติส่งเสริมวิสาหกิจเพื่อสังคม พ.ศ. 2562 มีวัตถุประสงค์มุ่งเน้นเพื่อส่งเสริมการประกอบธุรกิจให้เกิดการจ้างงานแก่ผู้ด้อยโอกาสและการแก้ไขปัญหาหรือพัฒนาชุมชน สังคม หรือสิ่งแวดล้อมหรือเพื่อประโยชน์ส่วนรวมอื่น แต่จากการศึกษาพบว่าพระราชบัญญัติดังกล่าวยังไม่มีการกำหนดสิทธิประโยชน์ตามที่กฎหมายบัญญัติไว้ กล่าวคือ ไม่มีหลักเกณฑ์การให้ความช่วยเหลือทางการเงินจากกองทุนสิทธิประโยชน์ด้านภาษีอากร สิทธิประโยชน์ตามมาตรการจัดซื้อจัดจ้างและการบริหารพัสดุภาครัฐ และมีปัญหาความล่าช้าในการออกกฎหมายลำดับรอง จึงควรแก้ไขเพิ่มเติมกฎหมายและเร่งออกกฎเกณฑ์ที่เกี่ยวข้องเพื่อส่งเสริมให้วิสาหกิจเพื่อสังคมขยายตัวมากขึ้นและเพิ่มขีดความสามารถในการแข่งขันทางการค้าทั้งภายในและระหว่างประเทศต่อไป
