ปัญหากฎหมายเกี่ยวกับการกำหนดโทษทางอาญาในการควบคุมการประกอบอาชีพหรือประกอบธุรกิจของคนต่างด้าวที่สงวนไว้สำหรับคนไทย

บทคัดย่อ
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) วิเคราะห์ปัญหากฎหมายในการกำหนดโทษทางอาญาในการควบคุมการประกอบอาชีพหรือประกอบธุรกิจของคนต่างด้าวที่สงวนไว้สำหรับคนไทย 2) ศึกษาเปรียบเทียบกฎหมายของประเทศไทย และกฎหมายต่างประเทศที่เกี่ยวกับการกำหนดโทษทางอาญาในการควบคุมการประกอบอาชีพ หรือประกอบธุรกิจของคนต่างด้าวที่สงวนไว้สำหรับประชาชนในประเทศ และ 3) เสนอแนะแนวทางแก้ไขปัญหากฎหมายในการกำหนดโทษทางอาญาในการควบคุมการประกอบอาชีพหรือประกอบธุรกิจของคนต่างด้าวที่สงวนไว้สำหรับคนไทย เป็นการวิจัยเชิงคุณภาพโดยรวบรวมข้อมูลจากหนังสือ บทความ วิทยานิพนธ์ รายงานการวิจัยและเอกสารที่เกี่ยวข้อง ผลการวิจัยพบว่า เมื่อเปรียบเทียบกฎหมายไทยกับกฎหมายต่างประเทศ พบว่า กฎหมายไทยที่เกี่ยวข้องกับการทำงานของคนต่างด้าว 3 ฉบับ ได้แก่ พระราชบัญญัติคนเข้าเมือง พ.ศ. 2522 พระราชกฤษฎีกากำหนดงานในอาชีพและวิชาชีพที่ห้ามคนต่างด้าวทำ พ.ศ. 2522 และพระราชกำหนดการบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 ยังมีบทลงโทษที่ไม่เหมาะสมกับผลกระทบที่เกิดขึ้น ทั้งต่อแรงงานไทย ระบบเศรษฐกิจ และปัญหาอาชญากรรม อีกทั้งโทษทางอาญายังไม่รุนแรงพอที่จะป้องกันการกระทำผิดซ้ำ แตกต่างจากกฎหมายต่างประเทศที่มีบทลงโทษเข้มงวดและมีประสิทธิภาพมากกว่า ดังนั้นควรแก้ไขกฎหมายไทยโดยเพิ่มโทษปรับและโทษจำคุกแก่คนต่างด้าว นายจ้าง หรือผู้ประกอบการที่ฝ่าฝืน รวมถึงกำหนดระยะเวลาห้ามเข้าประเทศอย่างชัดเจนเพื่อป้องกันการกระทำผิดซ้ำและลดผลกระทบต่อแรงงานไทยและเศรษฐกิจของประเทศ
