The case concerning the payment of annual car’s tax which unpaid of fine penalty according to the Traffic Act B.E 2522, that the Department of Land Transport can suspend issuing the tax payment document or not? (the effect of the Regulatory Offences Act B

Abstract

            This academic article reflects the problemof the Royal Thai Police Office could not enforce the unpaid tickets of the unperformed people who committed against traffic laws. There are still the big numbers of the unpaid tickets remain in each year. In the meantime, (2017) Thailand was ruled by junta under the name of “the National Council for Peace and Order”. And by the National Council for Peace and Order, the Order number 14/2560 was enacted an enforced in order to solve this problem since then. The main issue of this Order was, the owner of the car which was charged against traffic laws and received the ticket, who did not perform the fine penalty, the Department of Land Transport will suspend issuing the tax payment document for unperformed car’s owner. Later (2022), a new Act named the “Regulatory Offences Act B.E. 2565 (2022)” has been enacted which regulated to enforce all laws that provided criminal penalty only fine must be reregulated as mentioned in this Act. Moreover, this Act also provides the details of legal regulatory procedure to be implemented. Therefore, the Royal Thai Police Office and the Department of Land Transport could not enforce the Order number 14/2560 issued by the National Council for Peace and Order anymore.
