The Concept of true benefit in Roscoe Pound’s social engineering theory

Abstract

The purpose of this research article is to study origin, meaning, elements, and purpose of social engineering concept of Roscoe Pound a legal scholar and former dean of American Harvard Law School. The research is done by using documentary-based research method. Information is gathered from Roscoe Pound's books and articles and other relevant research works. Study is done through the conceptual framework of ethical utilitarianism by analyzing the issue of benefit sharing by law of Roscoe Pound's social engineering theory and summarize by descriptive research method. The study revealed that Roscoe Pound’s social engineering theory consists of fundamental theory of social engineering and sociology of law and Utilitarianism which seeks to improve and develop systems through scientific methods and social control. It includes of law sociological concept which focuses on lawyers to use social context to examine hypothesis rather than using traditional practices that do not care society. It also includes of concept of benefits of many people in society according to the ethical concept which sociology of law use as the basic idea of commandments or law enforcement making society harmonious. But when society is not harmonized due to conflicts of interests between private and other groups, laws have a duty to adjust the conflicting interests of those societies so that they can stay together in society well.
