การตัดสินใจเชิงจริยธรรมของผู้ประกอบวิชาชีพหนังสือพิมพ์และผู้มีส่วนได้ส่วนเสียต่อการนำเสนอภาพข่าวอ่อนไหวทางจริยธรรม

บทคัดย่อ

การวิจัยเชิงคุณภาพชิ้นนี้ มีวัตถุประสงค์เพื่อศึกษากฎหมาย อนุสัญญาสากล และจรรยาบรรณ ที่เป็นข้อห้ามหรือพึงระมัดระวังในการเผยแพร่ภาพข่าวอาชญากรรมและภาพข่าวอื่นๆ และศึกษาการตัดสินใจเชิงจริยธรรมของผู้ประกอบวิชาชีพหนังสือพิมพ์และผู้มีส่วนได้ส่วนเสียกลุ่มต่างๆ ที่มีต่อภาพข่าวอาชญากรรมและภาพข่าวที่ถูกร้องเรียนผ่านอนุกรรมการพิจารณาเรื่องราวร้องทุกข์ สภาการหนังสือพิมพ์แห่งชาติ รวมทั้งภาพข่าวที่มีความอ่อนไหวในประเด็นจริยธรรม โดยใช้วิธีการศึกษาจาก (1) สำรวจเอกสารกฎหมายที่เกี่ยวข้อง   (2) การสัมภาษณ์เชิงลึกแบบกำหนดประเด็นกลุ่มนักวิชาชีพและกลุ่มผู้มีส่วนได้ส่วนเสีย โดยอาศัยเครื่องมือ Potter Box ของ Ralph B. Potter, Jr. ศาสตราจารย์ประจำ Harvard Divinity School ในการกำหนดกรอบประเด็นคำถาม 4 ขั้นตอน ผ่านภาพข่าวอ่อนไหวทางจริยธรรมที่เป็นกรณีศึกษา ปี 2551-2552

ผลการวิจัยพบว่า กฎหมายหลายฉบับ ข้อบังคับ ระเบียบปฏิบัติเกี่ยวข้องกับการนำเสนอภาพข่าว ผู้ปฏิบัติงานยังใส่ใจน้อย ส่วนการตัดสินใจเชิงจริยธรรมของผู้ประกอบวิชาชีพหนังสือพิมพ์และผู้มีส่วนได้ส่วนเสียกลุ่มต่างๆ ต่อภาพข่าวอาชญากรรมและภาพข่าวที่ถูกร้องเรียนผ่านอนุกรรมการรับเรื่องราวร้องทุกข์ สภาการหนังสือพิมพ์แห่งชาติ มีทั้งเหมือนและแตกต่างกัน ในกรณีภาพประเด็นส่งเสริมความงมงายให้สังคม ประเด็นความรุนแรงและหวาดเสียว ประเด็นสิทธิส่วนบุคคลและภาพอุจาด ประเด็นด้านศักดิ์ศรีความเป็นมนุษย์ ประเด็นสิทธิเด็กและครอบครัว ประเด็นสิทธิของผู้ต้องสงสัยในการทำแผนประกอบคำสารภาพ ประเด็นภาพข่าวเผยแพร่จากองค์กร

ผลการวิจัยพบว่า การตัดสินใจเชิงจริยธรรมของผู้ประกอบวิชาชีพหนังสือพิมพ์และผู้มีส่วนได้ส่วนเสียแตกต่างกัน โดยกลุ่มผู้ประกอบวิชาชีพเน้นหลัก ‘หน้าที่' (means) ส่วนกลุ่มผู้มีส่วนได้ส่วนเสียเน้นหลัก ‘ผลกระทบ' (ends) ทั้งนี้กลุ่มผู้ประกอบวิชาชีพบางส่วนใช้หลัก ‘ผลกระทบ' ในบางกรณี

This qualitative research aimed at studying laws, international convention, and ethics which is prohibited or should be careful in publicizing criminal news photo and other kinds of photos, also studied ‘Doing Ethics' of professional journalists and different groups of stakeholders regarding criminal news photos, news photos complained via Subcommittee of Complaints Examination, National Press Council of Thailand, including ethically sensitive news photos. In-depth interviews and Potter Box by Ralph B. Potter, Jr., Professor at Harvard Divinity School were used as the research method and tool to limit areas of questions by considering sensitive news photos as the case studies.

Many laws and ethical regulations, cautions, and prohibitions relating to criminal news photos and other types of news photos were found in the research results. But many laws and those regulations are less intention.

The professional journalists and different groups of stakeholders hold both similar and different opinions towards criminal news photos and other types of news photos complained via Complaints Examination Subcommittee, National Press Council of Thailand, News photos which has ethical problems promoting credulity to the society and misguiding people from Buddhist beliefs, Violent and Terrifying case study, Privacy rights and salacious case study, Human rights problem case study, Case study of the rights of the child and family, Demonstrates the culprit's action case study, and Case study distributed from organizations which have ethical problems on the rights of the child.

The research results also were found that the ‘Doing Ethics' of the professional journalists and different groups of stakeholders were different. The journalists emphasized on ‘means' whereas the stakeholder groups weighed more on ‘ends'. Nevertheless, some groups of the journalists considered the ‘ends' principle in some cases.
