ข้อสังเกตเบื้องต้นต่อโฉนดชุมชนในฐานะกลไกการแก้ไขปัญหาความยากจน

บทคัดย่อ

          รัฐบาลไทยรับนโยบายของธนาคารโลกเรื่องการออกโฉนดที่ดิน ว่าเป็นปัจจัยหลักต่อการแก้ไขปัญหาความยากจนของเกษตรกรไทยโดยเฉพาะในเขตภาคเหนือและภาคตะวันออกเฉียงเหนือ ตั้งแต่อย่างน้อยในทศวรรษ 2520 นอกจากนี้ในรายงานของธนาคารโลกได้ส่งผลให้รัฐบาลไทยเข้าใจผิดเกี่ยวกับประชาชนที่อาศัยในชนบท หรือชุมชนในชนบท ว่าเป็นผู้ที่ไม่มีศักยภาพในการใช้ประโยชน์และอนุรักษ์ที่ดิน จากแนวความคิดเช่นนี้ทำให้รัฐบาลตีความเกี่ยวกับ “ชุมชน” ไม่ถูกต้อง ความหมายของคำว่า “ชุมชน” ในมุมมองของรัฐบาล หมายถึง พื้นที่ที่ยังไม่พัฒนาหรือหมู่บ้าน ซึ่งจะพบแนวคิดแบบนี้ได้ในแผนพัฒนาเศรษฐกิจและสังคมแห่งชาติและอย่างน้อยที่สุดใน “ระเบียบนายกรัฐมนตรี ว่าด้วยการจัดให้มีโฉนดชุมชน พ.ศ. 2553” และ “ประกาศคณะกรรมการประสานงานเพื่อจัดให้มีโฉนดชุมชน ว่าด้วยหลักเกณฑ์และวิธีการในการดำเนินงานออกโฉนดชุมชน พ.ศ. 2553” สมัยรัฐบาลนายอภิสิทธิ์ เวชชาชีวะ ที่ออกให้กับหมู่บ้านคลองโยง จังหวัด นครปฐม ซึ่งหลังจากที่ประกาศใช้แล้ว ปรากฏว่า เกษตรกรส่วนมาก ไม่เห็นชอบในข้อกำหนดของประกาศฉบับนี้ เนื่องจากไม่ได้มาจากความต้องการของชุมชนอย่างแท้จริง นอกจากนี้นับตั้งแต่ พ.ศ. 2553 เป็นต้นมาจนถึงปัจจุบัน (พ.ศ. 2557) ปัญหาความยากจนของเกษตรกรไทย ภายหลังการได้รับโฉนดชุมชน กลับยังไม่บรรเทาลง บทความนี้จึงมีวัตถุประสงค์ที่จะวิเคราะห์ถึงจุดอ่อน จุดแข็ง ของโฉนดชุมชน ในฐานะกลไกของการแก้ไขปัญหาความยากจน โดยใช้ระเบียบวิธีการศึกษาจากเอกสาร

          Royal Thai Government received the policy from World Bank since B.E.2520 (1977) that Land titling should help landless agriculturists to reduce the poverty especially in the northern and northeastern part of Thailand. The evaluation from World Bank’s paper had made miss understood for the Royal Thai Government that people who leaved in rural area or rural community had no potential in land use and land conservation. Such an idea, The Government interpreted the characteristic of “Community” incorrect. The meaning of “Community” from Government perspective are an underdeveloped area or villages. The impact of this idea can be seen in “The Economy and Social National Plan” at least in “The Regulations of the office of the Prime Minister on Community Land Title Deed B.E. 2553 (2010)” and “The Committee in charge of Community Land Titling B.E.2553 (2010), which were issued by the Government of the Prime Minister Abhisit Vejjajiva for Ban Klong Yong District, Nakorn Prathom Province. After issuance “The Community land title deed”, most of landless agriculturist did not like this certificate because it did not come from the demand of the community. At the same time, the poverty is nevertheless reduce up to present (B.E.2557). The aim of this article is to analyze the strength and weak point of the Community land Title Deed as a mechanism for poverty reduction by documentary research.
