บทคัดย่อ

การศึกษานี้มีวัตถุประสงค์ เพื่อจะศึกษาและวิเคราะห์การนำมาตรการคัดกรองบุคคลก่อนเข้าสู่ตำแหน่งสมาชิกสภาผู้แทนราษฎรด้วยการกำหนดคุณสมบัติผู้มีสิทธิสมัครรับเลือกตั้งสมาชิกสภาผู้แทนราษฎรโดยการแสดงสำเนาแบบแสดงรายการภาษีเงินได้โดยศึกษาข้อมูลจากการเอกสารทางกฎหมาย ทฤษฎีทางกฎหมาย เอกสารประกอบการพิจารณา  ร่างกฎหมายรัฐธรรมนูญ ตำรากฎหมายทั้งในประเทศและต่างประเทศ ตลอดจนงานวิจัยที่เกี่ยวข้องกับมาตรการคัดกรองบุคคลก่อนเข้าสู่ตำแหน่งสมาชิกสภาผู้แทนราษฎรของไทยและต่างประเทศ

จากการศึกษา พบว่า ประเทศไทยขาดมาตรการคัดกรองบุคคลก่อนเข้าสู่ตำแหน่งสมาชิกสภาผู้แทนราษฎร แม้จะมีคณะกรรมการการเลือกตั้ง (กกต.) มีหน้าที่กำกับดูแลการเลือกตั้งให้เป็นไปด้วยความยุติธรรม และคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ (ป.ป.ช.) มีอำนาจตรวจสอบการใช้อำนาจรัฐ แต่กระบวนการดังกล่าวเป็นการตรวจสอบ  ภายหลังจากการกระทำความผิดแล้ว จึงมีความจำเป็นต้องนำมาตรการคัดกรองบุคคลก่อนเข้าสู่ตำแหน่งสมาชิกสภาผู้แทนราษฎรด้วยการกำหนดคุณสมบัติผู้มีสิทธิสมัครรับเลือกตั้งสมาชิกสภาผู้แทนราษฎรโดยการแสดงสำเนาแบบแสดงรายการภาษีเงินได้   มาใช้เพิ่มประสิทธิภาพในการป้องกันการทุจริต เพื่อให้ได้บุคคลที่มีคุณธรรมและความประพฤติเป็นแบบอย่างที่ดีของสังคม

Abstract

The objective of this study is to analyze the measures, screened before entering to the position, the member of the House of Representative to qualify for the right candidate to show the copy of the income tax. The research is documentary research that studied from legal documents, legal theory documents, drafted constitution and legal texts, both domestic and foreign including research involved with the screening measures of candidate to be the member of the House of Representative of Thailand and abroad.

The study found that Thailand lacks measures for screening individuals before being selected for the members of the House of Representatives. Despite supervised by the Election Commission of Thailand (ECT) and investigated by the National Anti-Corruption Commission (NACC), the processes are the post-examined. Then it is necessary to have measures for screening candidate before enlisting as members of the House of Representatives by showing the copy of the income tax for integrity and a role model for society.
