การประเมินกระบวนการของการนำพระราชบัญญัติสภาองค์กรชุมชน พ.ศ. 2551 ไปปฏิบัติในพื้นที่กรุงเทพมหานคร

บทคัดย่อ

บทความนี้มีวัตถุประสงค์ในการวิจัยอยู่ 2 ข้อ คือ 1. เพื่อประเมินกระบวนการของการนำพระราชบัญญัติสภาองค์กรชุมชน พ.ศ. 2551 ไปปฏิบัติในพื้นที่กรุงเทพมหานคร และ 2. เพื่อจัดทำข้อเสนอแนะเชิงนโยบาย และเชิงปฏิบัติที่เป็นประโยชน์ต่อการแก้ไข และพัฒนาพระราชบัญญัติสภาองค์กรชุมชน พ.ศ. 2551 และมาตรการที่เกี่ยวข้อง ตลอดจนการบริหารจัดการ และการดำเนินงานต่างๆ ให้มีประสิทธิภาพ และประสิทธิผลมากขึ้น โดยผลการศึกษา พบว่า

การนำพระราชบัญญัติสภาองค์กรชุมชน พ.ศ. 2551 ไปปฏิบัติในพื้นที่กรุงเทพมหานคร มีปัญหาทั้งในระดับมหภาค  และจุลภาค  โดยในระดับมหภาคมีปัญหาที่สำคัญ  คือ  กฎหมายระดับอนุบัญญัติที่ต้องออกตามพระราชบัญญัติสภาองค์กรชุมชน  พ.ศ. 2551  สามารถออกได้เฉพาะเรื่องที่อยู่ในความรับผิดชอบของสถาบันพัฒนาองค์กรชุมชนโดยตรง แต่เรื่องอยู่ในความรับผิดชอบของกรมส่งเสริมการปกครองท้องถิ่น  ซึ่งได้แก่  หลักเกณฑ์การให้เงินอุดหนุนแก่สภาองค์กรชุมชนขององค์กรปกครองส่วนท้องถิ่น  ยังไม่มีการดำเนินการ ทำให้เกิดปัญหาในการให้เงินอุดหนุนแก่ สภาองค์กรชุมชนขององค์กรปกครองส่วนท้องถิ่น  นอกจากนี้การที่แผนยุทธศาสตร์การขับเคลื่อนสภาองค์กรชุมชนกับแผนงานการสนับสนุนการขับเคลื่อนสภาองค์กรชุมชน  ยังไม่มีความสอดคล้องซึ่งกันและกันอย่างแท้จริง  ก็ได้ส่งผลทำให้การดำเนินการส่งเสริมกิจการสภาองค์กรชุมชนในภาพรวมทั้งประเทศ  ยังขาดความชัดเจน ขาดความเป็นเอกภาพ  และขาดพลัง

ส่วนในระดับจุลภาคมีปัญหาที่สำคัญ  ได้แก่  การที่กรุงเทพมหานคร ยังไม่ให้การยอมรับ  และความร่วมมือในการดำเนินการตามพระราชบัญญัติฯ เท่าที่ควร  การขาดแคลนแกนนำ  และสมาชิกสภาองค์กรชุมชนในพื้นที่กรุงเทพมหานครทั้งในเชิงของปริมาณ  และคุณภาพ  และการที่สภาพแวดล้อมทางการเมืองของพื้นที่กรุงเทพมหานครมีลักษณะที่เป็นอุปสรรคต่อการดำเนินการตามพระราชบัญญัติสภาองค์กรชุมชน พ.ศ. 2551

Abstract

This paper has two main research objectives:  1. to evaluate process of Community Organization Councils  Act B.E. 2551 (2008) Implementation in Bangkok Area and 2. to make useful policy recommendations and operation recommendations to solve  problems and develops Community Organization Councils Act B.E. 2551 including the involved measures throughout the management process,  which lead to more efficiency and effectiveness. This research has found that :

The Community Organization Councils Act B.E. 2551 Implementation in Bangkok area, there are the macro and micro problems. The important macro problems are the subordinate legislation, which following the Community Organization Councils Act B.E. 2551, can cover on the direct responsibility by Community Organizations Development Institute mission only, but the principle of subsidies for Community Organization Councils of Local government, which is the direct responsibility by Department of Local Administration has not yet implemented. It leads to problems in giving Local government subsidies to Community Organization Councils. Moreover, the unclear accordance of Strategic plan to drive Community Organization Councils and Program to support the drive of Community Organization Councils cause lacking of clearness, lacking of unity and lacking of power for the whole country picture of Community Organization Councils supporting implementation.

The important micro problems are the inadequate adoption and cooperation of Bangkok in Community Organization Councils Act B.E. 2551 implementation, lack of leader and member of Bangkok Community Organization Councils; both in Quantitative and Qualitative aspect, the obstacle of Community Organization Councils Act B.E. 2551 implementation from political environment.
