Legal issues concerning Constitutional Amendment Guidelines and Process in Kingdom of Thailand’s Constitution of 2017

The purpose of this article is to study legal issues and search appropriate process concerning constitutional amendment in Kingdom of Thailand’s Constitution of 2017 by means of comparative study which compare constitutional amendment in Thailand and foreign country
The study has shown that Kingdom of Thailand’s Constitution of 2017 apparently provided constitutional amendment, but prescribe many terms and conditions which amendment to the constitution is more difficult than it should be. That is to say the terms and condition cause amendment is delayed and amendatory power is not truly from the parliament; furthermore it also empower the constitutional court to revise bills on constitutional amendment draft. This situation may affect constitutional amendment in the future. By the result of this study, the authors suggest to amend constitutional amendment guidelines and process by repeal the approval of three-fourths of the member of the senate house and repeal revising bills on constitutional amendment via constitutional court.
