ปัญหากฎหมายในการควบคุมพืชกระท่อม

บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อศึกษาพัฒนาการทางกฎหมายในการควบคุมพืชกระท่อม สรรพคุณ ลักษณะการบริโภค รวมถึงผลที่จะได้รับจากการบริโภคพืชกระท่อม ศึกษาวิเคราะห์กฎหมาย หน่วยงานควบคุม มาตรการควบคุมของต่างประเทศ เพื่อนำมาสู่การจัดทำข้อเสนอแนะการควบคุมการใช้พืชกระท่อมที่เหมาะสมตามบริบทของประเทศไทย จากการศึกษา พ.ร.บ.พืชกระท่อม พ.ศ. 2565 พบว่ามีการกำหนดมาตรการควบคุมการบริโภค การจำหน่าย การนำเข้า ส่งออก รวมถึงควบคุมการนำพืชกระท่อมไปใช้ในทางที่ไม่ถูกต้อง ผู้ใดฝ่าฝืนมีโทษสูงสุดจำคุกไม่เกิน 2 ปี หรือปรับไม่เกิน 200,000 บาท หรือทั้งจำทั้งปรับ ซึ่งภายหลังจากการประกาศใช้ พ.ร.บ.พืชกระท่อม พ.ศ. 2565 พบว่ามีการบริโภคและจำหน่ายจำนวนมาก ในขณะที่ยังไม่มีการประกาศใช้กฎหมายลำดับรองเพื่อมาควบคุมการบริโภค การจำหน่ายและการปนเปื้อนในอาหาร พ.ร.บ.พืชกระท่อม พ.ศ. 2565 จึงยังไม่เพียงพอที่จะควบคุมการใช้พืชกระท่อมให้เป็นไปอย่างถูกต้องเหมาะสม
