PROTECTION OF THE RIGHT TO BE FORGOTTEN

This research aims to (1) study the background of the right to be forgotten, including the definition, characteristic and scope of the right to be forgotten, (2) study the protection of the right to be forgotten principle and the guidelines on the protection of such right according to foreign and international law, and (3) study and analyze the guidelines on the protection of the right to be forgotten. This study uses research methodology in law (Documentary Research) by studying from related books, articles, theses, court’s judgments, electronics articles, academic documents, law of the Kingdom of Thailand, international law, and foreign law
According to the Personal Data Protection Act B.E. 2562, there are provisions that is not clearly determined the criteria to construe and consider the scope of the right to be forgotten which may affect the applicable of the right to be forgotten. Therefore, the amendment shall be made to the Personal Data Protection Act by determined the definition and criteria on the using of the right to be forgotten as guidelines on the protection of the right to be forgotten which conform with Thai society.
