THE EXTENSION OF THE REGISTERED TRADEMARKS AND UNREGISTERED TRADEMARKS PROTECTION
Abstract
The objective of this study is to examine the extension of the right protection of the registered trademarks and unregistered trademarks owner. The Thai Trademarks Act, Amendment (No.2) Act, B.E.2543, section 4 is compared with The Lanham Act (15 USCA § 1125 (a)) under §43 (a) The study found that the rights of Trade Dress protection have broader scope than Trademark Act, section 4. It has been found that the trademark owners need to collaborate with both public and private sectors for the rights of trademarks protection. If Trademarks Act, section 4 is expanded the definition of the word “Mark” and “Trademark”, the consumers will not be confused or misled into buying goods.
