STATE JURISDICTION OVER A CRIMINAL THROUGH AN EXTRADITION

Abstract

The article analyses the main principles of the International Law relating to the extradition. The consensus in international law is that a state does not have any obligation to surrender an alleged criminal to a foreign state as one principle of sovereignty is that every state has legal authority over the people within its borders. Extradition should be regarded as a tool to prevent the fleeing away of transnational criminals who usually snatch the advantages from the limits of law enforcement, which often end at the border, as well as loopholes arising from the different laws and practices among nations to escape from justice
