บทคัดย่อ

บทความนี้เป็นบทความทางวิชาการที่มีวัตถุประสงค์เพื่อวิเคราะห์หลักการความรับผิดชอบในการปกป้อง โดยนำเสนอมุมมองของเหตุผลทางกฎหมายในเชิงทฤษฎีและความมีประสิทธิผลของการปฏิบัติ ในส่วนแรก เป็นเรื่องความรับผิดชอบในการปกป้องในทางทฤษฎี โดยศึกษาวิวัฒนาการ และสรุปพื้นฐานของหลักการ และวิเคราะห์รายงานและเอกสารที่เกี่ยวข้อง หลักการนี้มีการกำหนดความรับผิดชอบสำหรับรัฐต่างๆ ในฐานะสมาชิกของประชาคมระหว่างประเทศไว้ อย่างไรก็ตาม แม้ว่าจะมีข้อตกลงของความรับผิดชอบระหว่างรัฐไว้ แต่มีการโต้แย้งว่าหลักการนี้ไม่สามารถนำไปปฏิบัติให้เกิดประสิทธิผลได้อย่างแท้จริง ในส่วนที่สอง เน้นข้อมูลของความรับผิดชอบในการปกป้องในทางปฏิบัติ โดยวิเคราะห์ผลกระทบทางจริยธรรมและทางกฎหมาย ผ่านกรณีศึกษาใน ประเทศลิเบีย ประเทศซีเรีย ประเทศเมียนมา และ วิกฤตระหว่างประเทศรัสเซียและประเทศยูเครน นอกจากนั้น ในส่วนที่สาม ได้วิเคราะห์ข้อบกพร่องและวิพากษ์ทางปฏิบัติของหลักการ โดยวิเคราะห์จุดอ่อนโดยรวม โดยมีจุดมุ่งหมายเพื่อพิจารณาว่าหลักการความรับผิดชอบในการปกป้อง ในทางปฏิบัตินั้นสามารถให้ความชอบธรรมและเกิดประสิทธิผลในการปกป้องสิทธิมนุษยชน ได้อย่างแท้จริงหรือไม่
