Guidelines for Legal Development to Promote and Support Sustainable Development in Rail Transport Business in Thailand

Abstract
Public infrastructure Investment in the rail transport sector through transit-oriented development (TOD) leads to sustainable economic, urban, social, and community development. The objective of the study was to examine the development of legal measures to promote and support the rail transport business and the development of the areas surrounding the stations, which such developments had resulted in the higher economic value of the real estate. However, the owner was not involved in the development and investment in the public infrastructure and transit-oriented development. The study found that Thailand had no legal measures on rail infrastructure management, transit-oriented development, and collection of taxes from those who benefit from such investments by the state. The results of the study were that Thailand should enact sui generis law as follows: first, legal measures on rights, duties, and liabilities of infrastructure managers, second, legal measures on transit-oriented development investment, third, windfall gain tax law should be enacted to collect from real estate owners by land value capture concept as a tool to reduce inequality and improve the economy, society and community in response to sustainable economic growth.
