PROBLEMS AND SOLUTIONS FOR ADMINISTRATIVE MANAGEMENT OF THAI ADMINISTRATIVE COURTS

Abstract

This research aims (1) To study legal problems and administrative proceedings of the current Administrative Court. (2) To study the Expert opinion on the reformation guidelines of the administrative Court system. By using qualitative research, documentation and in-depth interviews. There were 6 groups in this research: the judge of the first class Administrative Court, judge of the Supreme Administrative Court, Public Prosecutor, academic, lawyer, and people involved in the ruling administrative case. Each group consists of 5 persons, total of 30 persons. The research instrument was a structured interview are open-ended quantitative questions. The data will be analyzed in descriptive form. The results of the research showed that the administrative court had problems relating to the administrative structure of the Administrative Court, the judicial system of the Administrative Court, the right of the people to prosecute, and Judgment of the Administrative Court. There is a need to amend the Act Establishing the Administrative Courts and the Administrative Court Procedure, B.E. 2542 (1999). The restructuring of the Administrative Court is a 3-tier court: the Court revises the selection committee, appoints the Judge of the Administrative Court, improve the treatment of people ’s rights in administrative case prosecutions, and improve the treatment of judgments procedure in administrative case.
