The Problem of Political Fake News on Social Media : Challenges of Regulation and Law Enforcement in Thailand

Abstract

This article aims to study the problems related to the dissemination of fake news which is false, fake or misleading information which may cause the delusion of the individual causing divided opinions among people in society and affects and damages the political society or the stability of the country by comparative analysis of the laws related to the dissemination of fake news in Thailand and the French Republic of the study found that Thailand has enacted the Computer Crimes Act B.E. 2007 and its amendments, B.E. 2560, which are laws that govern the dissemination of illegal computer data. Unlike the laws of the French Republic which has specific laws regarding the dissemination of political fake news, it gives the court the power to issue orders to remove content on the Internet that the court deems to be a misrepresentation of facts during an election. and the law states that the user must obtain “Fair, clear and transparent information” which if an act of intentional dissemination of false information and is likely to affect the vote. Therefore, this article recommends that the rules be amended in order to protect the public interest and freedom of expression of the people.
