LEGAL PROBLEMS ON THE CONSENT OF THE ORGAN DONORS WHO PASSED AWAY AND THEIR CONCERNED PARTIES

This article aims to study the problems of laws on consent given by the persons who donate the organs after death and relevant persons and legal measures on controlling organ transplantation in Thailand in comparison with the organ transplantation guidelines of World Health Organization (WHO), and legal measures of certain countries; for instance, Republic of Singapore, United Kingdom, and the United States of America.
According to the study, there are lack of initial criteria of laws on determining the authorized persons, procedures, and methods of giving consent in donating organs and laws on legal offense exemption of medical personnel from organ transplantation, despite the fact that certain principles of law; for example, principle of consent, principle of public order and good morals, or principle of liberalization can be applied thereto.
Therefore, due to no specific law, the researcher proposes providing specific laws as the bills on organ transplantation and human organ donation after death for the benefit of treatment.
