Proactive Legal Framework for Regulating Digital-Era Tour Operator Businesses

This research aims to study: 1. To study the risks, roles, and operational characteristics of digital-era tour operators, including online platforms, new service providers, and their impact on consumers; 2. To analyze the limitations and gaps of the current travel business and tour guide laws, which are insufficient to accommodate the behaviors, service models, and risks of online travel businesses; and 3. To propose a proactive legal framework for regulating Thailand's digital-era travel business, focusing on enhancing consumer protection, overseeing online operators, and enforcing the law in a digital context. This is qualitative research, with key informants being legal experts, travel business operators, tourists, and representatives from government agencies, totaling 10 individuals. Data were collected through document study, in-depth interviews, and field observations. Content analysis and thematic analysis were conducted, with data quality verified through triangulation and member checking, following research ethics principles, to reflect perspectives on proactive legislation for regulating digital-era travel businesses.
Research findings indicate that the current legal framework is still unable to accommodate the new types of travel business conducted through digital media, such as online tour sales, advertising via social media platforms, booking and payment through electronic systems, as well as services provided by unlicensed operators, which pose risks to both consumers and the image of Thailand's tourism industry. The law also lacks provisions that set standards for online service delivery, advertising channels, verification of business operator information, and mechanisms to protect tourists when purchasing services through foreign platforms. The Tourism Business and Tour Guide Act B.E. 2551 should be amended to establish a registration system for digital operators with Digital KYC, have a registration system for operators operating on online platforms, set standards for online tour advertising, develop a real-time online complaint system with rapid response, set up an online tourism complaint center to receive, investigate, and use technology to analyze risks from pages or service providers exhibiting abnormal behavior, in order to prevent damage before it occurs and increase consumer confidence.
