LEGAL PROBLEMS ON THE EMPLOYMENT OF THE ELDERLY IN THAILAND

This research aims to (1) study the laws relating to the elderly employment of the elderly, (2) analyze the legal problems and make suggestions related to the employment of the elderly in Thailand. This research used the qualitative research methodology. The data were collected by research, documents, interviews and focus group.
The results of this research reveal that (1) The main laws relating to the employment of the elderly in Thailand are 1) The Constitution of the Kingdom of Thailand 2017 2) Civil and Commercial Code 3) The Elderly Act 2003 4) The Labor Protection Act 2541 (2) Legal issues relating to the employment of workers Elderly in Thailand. 1) The laws do not cover in work issues and do not relate with the changing context. 2) Lack of clear legal measures on the employment of elderly workers including measures to promote the employment of the elderly. 3) The lack of clear legal forms: collective regulations laws for the employment of concrete elderly workers. (3) Suggestions related to the employment of elderly workers in Thailand include that 1) Bringing laws related to hiring foreign workers as a good practice to improve the laws to suit the context of Thailand. 2) enactment and review of the employment laws for elderly workers should be based on the problem of hiring elderly workers. 3) Establishing laws to protect the elderly labor and laws to promote the elderly employment.
